Institutional Support, Amicable Settlement & Commercial Arbitration for Exporters and International Buyers

PCTMEA maintains a dedicated Standing Committee on Trade Disputes & Arbitration to facilitate amicable, fair, and expeditious settlement of commercial disagreements between member exporters and local or foreign buyers, raw material suppliers, shipping lines, and trade partners.

Nature & Scope of Trade Disputes Handled

The dispute resolution mechanism provides mediation across diverse international and domestic canvas, shelter, and textile trade disagreements:

Non-Payment or Delayed Settlement Default in export payment remittances, disputed deductions, or delayed release of Letter of Credit proceeds by foreign consignees.
Product Quality & Specification Disputes Disagreements concerning canvas fabric GSM, tensile strength, waterproof coating, colorfastness, or stitching standards vs purchase specifications.
Shipment Delays & Contract Cancellations Controversies arising from force majeure events, shipping container delays, demurrage claims, or unilateral order cancellations.
Domestic Supplier & Yarn Defaults Commercial disputes between member conversion units and domestic spinning or dyeing mills regarding raw material delivery and quality.

Conciliation & Mediation Mechanism

Stage 1: Complaint Lodgment & Document Verification

The aggrieved member or foreign buyer submits a formal complaint with complete documentary evidence (Contract, PO, Invoices, BL, inspection report, and correspondence history).

Stage 2: Official Notice & Bilateral Explanation

The Secretariat issues formal communication to the respondent party requesting counter-explanation and balance statement within 14 working days.

Stage 3: Conciliation Hearing & Amicable Settlement

The Dispute Committee convenes an in-person or virtual hearing with both parties to negotiate a mutually agreed settlement, discounted resolution, or replacement shipment schedule.

Stage 4: Institutional Referral (Trade Mission / TDAP / FPCCI)

If a foreign buyer fails to cooperate or commits deliberate fraud, the case is officially forwarded to Pakistan's Commercial Counselor / Trade Mission in the respective country and the FPCCI Dispute Directorate.

Commitment to Amicable Resolution: Over 85% of commercial claims lodged with the PCTMEA Standing Committee are successfully resolved without recourse to prolonged international court litigation.
